~ TERMS OF SERVICE ~
Thank you for considering the Spruce Lake Resort (the “Resort”). The following terms and conditions have been set to ensure the comfort, enjoyment, and safety of our guests. By staying at the Resort, you are agreeing to adhere to these Terms and Conditions. Please ensure that you, your invitees, friends and family understand them. The Manager at the Resort is charged with enforcing these rules and has the authority to terminate your stay immediately, without refund, if these rules are not respected. Registered guests are responsible for the conduct of their invitees, friends and family at all times, and will be held financially responsible for any damage caused to the property or equipment of the Resort. The term “guest(s)”, as used in this agreement, includes all parties signing the agreement.

Candles are not permitted inside the Glamping RV’s (the “RV’s”) under any circumstances.

Quiet time is from 10:00pm to 8:00am every night. For the comfort of our guests, there is no tolerance for noise after 10:00pm and before 8:00am. This resort is for the quiet enjoyment of all our guests. To ensure an enjoyable camping experience for all, excessive noise, loud music, foul language, and unruly or disruptive behaviour will not be permitted at any time of the day or night.

Smoking is NOT permitted in the RV’s or on the RV sites (the “Sites”). Failure to comply will result in a $1,000 cleaning fee. Please refrain from smoking in areas that are shared with other guests, including, but not limited to, the dock, playground, beach and recreation room. Cigarette butts are to be placed in proper receptacles provided, not on the ground or in the fire pit. Alcohol is to be consumed responsibly at your Site. Please be considerate of your neighbours throughout the resort.

CHECK-IN for the RV’s begins at 4:00pm. CHECK-OUT for the RV’s is no later than 10:00am. All RV’s have digital keypads and you will be provided with your unique code prior to check-in.

Please respect the privacy of other guests. Do not walk through occupied Sites and please do not discard any food or other bear attractants in the fire-pits. No waste (yard or household) is to be left to accumulate on a Site, including in the fire-pits.

Use of water balloons is prohibited due to the debris and environmental contamination.

No jumping off of the dock, littering, or entering into fenced areas. Do not move or remove picnic tables from Sites or public areas.

All common areas must be enjoyed with the consideration of others in mind.

All wildlife, grass, vegetation, and infrastructure must be kept from harm or damage.

Fireworks and the use of drones are prohibited at the Resort.
Vehicle Restrictions
The Sites are only for loading and unloading during your stay. Please do not park at your Site. Assigned parking by Site number is provided by corresponding numbered stalls. After parking, you must walk back to your Site. Parking in unauthorized areas or unoccupied Sites may require vehicles to be towed without notice at the vehicle owner’s expense.
Dock, Play Structure & Beach
Fishing is permitted off the dock, but not on the beach. Swimming or jumping from the dock is not permitted. Kayaks, stand up paddle boards, a canoe and a pedal boat are available for both adults and children’s use, in various sizes. If you have small children we recommend bringing life jackets specifically for them to ensure a proper fit. Life jackets should be worn at all times when using the supplied equipment. There is no lifeguard on duty so swim at your own risk. Children under the age of 12 must be supervised by a responsible adult at all times while on the property, but especially when they are at the beach. The Resort and its operates shall not be responsible for any losses, injury or damage resulting from improperly fitted or used life jackets or life jacket failure.
Water supply
A Boil Water Advisory in effect. Our water is supplied from the lake and therefore must be boiled for one (1) minute prior to consumption. Please bring bottled water for your own use, but it can be purchased at Keewatin Grocery, if needed.
Campfires
All of our Sites have private fire pits. Firewood is available for purchase on site and payment made by way of E-transfer to Sprucelakeresort@gmail.com. Alternatively, firewood may be purchased at Lot 1 McKenzie Portage Rd from LOTW Timberworks (road side stand), McMunn and Yates or any gas station Keep your fire small and under control with the grate over it and never leave a fire unattended. If you have to leave for some reason, or are done with the fire for the night, please extinguish the fire completely with water. Firewood. Fire pits are not to be relocated within the Site, nor removed from the Site. Do not remove bark or damage trees on the grounds ($1,000.00 fine), or collect wood from the surrounding bush or forested areas. No garbage is allowed in the fire pits provided by the Resort. Please check for fire bans or restrictions prior to lighting a fire. All fires must be monitored by an Adult
No Pets
Unfortunately, out of respect for local wildlife, other guests, and our neighbours, pets are not allowed.
Visitors
Visitors will need to vacate the property by 10:00pm.
Trash
All garbage must be deposited in the garbage receptacle provided and taken to the green GFL refuse bin located by the garage after check-out. Please ensure the lid is closed so as not to attract wildlife. Campsites must be kept clean and free of food scraps. We have bears for neighbours, and unfortunately a fed bear is a dead bear
Cancellation Policy
Cancellations for bookings made directly through the Resort require a thirty (30) day notice period from the date of check-in for a full refund. If the thirty (30) day notice period for cancellation is not met, we will cancel the reservation and attempt to re-book with other guests. If we are successful in finding other guests, you will receive a full refund. If we are not successful in finding other guests, you will be required to pay the full price of your booking.
If you booked on a third party platform, including, but not limited to, VRBO or Airbnb, their cancellation policies take precedence over ours. Please log into your account for the third party platform and check their cancellation policy. All booking cancellations from third party platforms need to be initiated with them on their platform. We cannot cancel a third party reservation without you first requesting cancellation on the respective third party portal.
The Resort will not be held liable for, or provide refunds for, cancellation of bookings and shortened stays because of force majeure events or conditions beyond the Resort’s control, including, but not limited to, bears, rodents or wildlife of any type, storms, floods, explosions, fire, civil disobedience, war, epidemic/pandemic, legislation not in force at the date of this agreement, labor disputes or delays of third parties. The Resort will also not be held liable for failure to carry out arrangements and other obligations due to the same circumstances.
RV Replacement
In rare cases that the RV you reserved needs to be repaired and can’t host your stay, we will endeavor to switch your group to another available RV. If a replacement can’t be provided from us, we will reschedule or cancel your booking and will refund your full payment without deducting any processing fee.
Security Deposit
We require a security deposit of $500.00 for each RV prior to check-in. This can be made by credit card and will be refunded after the RV is inspected at check-out. The inability to provide a security deposit may result in a booking denial, without a refund.
Cleaning and Resort Fees
A cleaning & Resort fee of $89.00 plus HST will be added to all reservations.
Please always leave your shoes outside before entering the RV’s. A fee of $250.00 plus HST for excessive cleaning will apply if you or your guests do not practice basic cleaning habits, including, but not limited to, cleaning up accidental spills that can cause permanent stains to interior floors, furniture, bed linens, and walls. In the event of permanent damage to the foregoing from red wine spills, vomit, blood, excessive dirt and any other permanently staining materials, you will be charged the total cost to replace or repair damage, whichever is more. We ask that common sense be used to minimize the potential of additional fees.
Insurance
Your, and your guests’, personal items and property are not covered by our insurance and are the sole responsibility of you and your guests.
Safety
Enjoy staying in our RV’s at your own risks. Only children are allowed to use the top bunk beds. Always watch your children when they climb up the ladders to the top bunk beds or loft.
Cooking
Please be considerate of other guests and refrain from bringing food with strong smells into the RV including, but not limited to, the fridge, freezer, sink, pots, or cooktop. It is prohibited to clean or cook seafood products with shells or with strong smells inside the glamping RV’s. Please cook with strong smelling food outdoors only to avoid smells from affecting other guests. Do not put any food or grease down the sinks as this will clog the drains and result in a fine equalling the amount of the cost to fix any damage.
BBQ
BBQ utensils are in the BBQ. Open the lid and remove the BBQ brush prior to lighting.
After cooking, turn the BBQ on high for a couple minutes to burn off any food remaining. Turn off the propane cylinder valve and turn the control knobs to “Off”. When the BBQ has cooled down, clean the grill and replace the cover.
Sewer
Only RV or septic safe toilet paper can be flushed down the toilet. Please always use the RV toilet paper provided by us and refrain from flushing ANY other papers or feminine hygiene products down to the toilet, including, but not limited to normal toilet paper, facial tissue, make-up removing wipes, and paper towels. You will be responsible for any repairing materials and/or labors if the damage is caused by your party.
Control Panel
Please make sure to check the indicating lights of the black and grey tanks often. If any of them indicates full “F”, please contact us to deplete it for you. Please do not deplete the tanks by yourself. Do not operate buttons for slides or other equipment other than the awning or lighting, as this can damage the RV’s.
Air Conditioning
It is important not to over use the A/C. If operating, please close the windows and vents. If you are planning to be absent, please turn the A/C off. Excess use will ice up the RV which will make it inoperable. A surcharge of $200.00 will be applied accordingly.
Fridge
When entering the RV, please double check fridge setting to see if it is correctly set at auto mode, instead of gas-only mode. Please do not force the use of gas as a power source. It will quickly run out the gas tank and cause the fridge not in function. Over storage of food will cause the fridge not to function. Should you need any help, please reach out.
Hot Surface
Most RV sinks and kitchen counters are made of plastics. Do not put hot pots or hot items directly on the sinks or countertops as it may cause damage.
Bathroom
Please plan a 30 minute gap between each shower to allow water heater to hold sufficient hot water for the next shower. After a shower, please always keep the fan cover open and frequently turn on the bathroom fan to boost better moisture release, in order to avoid mold from growing.
Awning
Use the awning with extreme care. In moderate to heavy winds, when you are absent or during the night, they must be retracted for your safety. Awnings can be damaged very easily, therefore keep all fires a safe distance away. Do not BBQ under the awning as smoke trapped by the awning will activate the interior smoke detector. Ensure that you have the awning high enough to prevent windows and doors from rubbing on the bottom side. During rain, tilt one corner lower than the other to allow runoff. You can always reach us for help should you have any questions. Use of the awning is the sole responsibility of the guest. If the awning is deployed, then it is recognized that the guest has agreed to accept all responsibility for the awning.
Check-out Policy & Procedures
Check out time is 10:00 AM. If no prior arrangements have been made for a late check-out, you may be charged to cover the extra time housekeeping must wait. Our cleaners are one a tight schedule and we most likely have new guests coming in.
You are required to leave the RV in the same general condition that it was received in, including completing the following:

Please wash all dirty dishes, and put them back where you found them.

Empty the refrigerator and freezer. Place the contents of the refrigerator and freezer (except fish remains) in the outside garbage receptacles or take them with you.

Take out the garbage. Before you leave, please take all garbage into the dumpster near the garage and ensure the lid is securely locked to keep out wild animals.

Please do not make up the beds you or your guests use at departure.

Put things back where they were when you arrived.

Check to be sure you are taking all your belongings with you.

Turn off all lights and the thermostat A/C. Retract the awning.

Check and lock all the exterior entry doors, windows and ceiling vent.

SPRUCE LAKE RESORT
ASSUMPTION OF RISKS, RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT
(hereinafter referred to as the “Release Agreement”)
BY STAYING AT THE RESORT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOR ANY DAMAGE OR INJURY TO YOU AND/OR YOUR PROPERTY.
PLEASE READ THIS RELEASE AGREEMENT CAREFULLY! IF YOU DO NOT READ THIS RELEASE AGREEMENT, YOU AND YOUR PARTY WILL NOT BE PERMITTED TO ENTER OR TAKE PART IN ANY ACTIVITY AT SPRUCE LAKE RESORT.
TO: SPRUCE LAKE RESORT (the “Resort”) and their respective directors, officers, employees, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors and assigns (hereinafter collectively referred to as the “Releasees”).
ASSUMPTION OF RISKS
I am aware and understand that:
1. During my stay at the Resort, I will be exposed to a variety of hazards, dangers and risks, foreseen and unforeseen, which are inherent to a campground, resort and lake environment, and to the activities occurring therein. The hazards, dangers and risks include, but are not limited to, hazards, dangers and risks from fire, soil, water, collision or impact with vehicles, watercraft, docks and pilings, sudden weather changes, wildlife, insects, falling objects, sharp objects, tripping hazards, slippery surfaces, drowning, and the NEGLIGENT (including GROSSLY NEGLIGENT), INTENTIONAL or OTHERWISE actions and omissions of other persons, including without limitation, the Releasees;
2. As a result of exposure to the hazards, dangers and risks present at the Resort, I may suffer damage to my property, personal injury, death and loss resulting therefrom;
3. Medical facilities and trained medical staff are not available at the Resort and injuries which I may suffer may not be treated for an extended period of time, which may result in an increased severity of injury and/or death;
4. In the face of the hazards, dangers and risks present at the Resort, I must exercise extra care for myself and others around me, including minors in my care; and
5. I must obey the rules of the Resort, and ensure that minors in my care obey the bylaws, policies and rules of the Resort.
I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH MY TIME AT THE RESORT AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
In consideration of the Resort permitting me to enter the Resort and take part in the activities offered, sponsored, or permitted by the Releasees at the Resort, I hereby agree as follows:
1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES and TO RELEASE THE RELEASEES from any and all liability for any harm, claim, loss, costs, damage or injury including death that I may suffer, or that my next of kin may suffer, resulting from either my use of or my presence at the Resort DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE UNDER THE OCCUPIERS’ LIABILITY ACT R.S.O. 1990, c. O.2, ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE HAZARDS, DANGERS AND RISKS OF THE RESORT;
2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property of, personal injury to, or death of, any third party or minor(s) accompanying me at the Resort resulting from my use of or my presence at the Resort, regardless of whether I am responsible for or could have prevented or mitigated such damage, injury or death;
3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
4. This Release Agreement is intended to be as broad and inclusive as is permitted by law. If any provision of this Release Agreement is held to be invalid or legally unenforceable for any reason, the remainder of the Release Agreement shall not be affected thereby and shall remain valid and fully enforceable;
5. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by, and interpreted solely in accordance with, the laws of the Province of Ontario and no other jurisdiction; and
6. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario.
In entering into this Release Agreement, I am not relying upon any oral or written representations or statements made by the Releasees with respect to the safety of the Resort, or the activities available at the Resort, other than what is set forth in this Release Agreement.
I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY STAYING AT THE RESORT, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES
